Nell'affabilità e cultura dei salotti milanesi, nlla bellezza delle donne fiorentine e nella libertà delle venziane, negli intrighi concistoriali e nella sfacciata simonia della corte di Roma, nel 'termometro' di San Gennaro e nella miseria dei 'lazzaroni', Montesquieu, che visita l'Italia tra l'agosto 1728 e il luglio 1729, scruta con curiosità puntigliosa la vita e la morte degli Stati italiani del Settecento, ancorati alle proprie civiltà in declino.

'Nel nostro attuale modo di essere, il nostro animo gusta tre specie di piaceri: alcuni emergono dal fondo della sua stessa esistenza, altri derivano dalla sua unione con il corpo, altri infine sono fondati sulle pieghe e sui pregiudizi che certe istituzioni, certe usanze e certe abitudini gli hanno fatto assumere. Sono questi diversi piaceri dell'animo a formare gli oggetti del gusto, come il bello, il buono, il gradevole, l'ingenuo, il delicato, il tenero, il grazioso, il non so che, il nobile, il grande, il sublime, il maestoso... Per esempio, quando proviamo piacere nel vedere una cosa di una certa utilità, diciamo che è buona; quando proviamo piacere nel vederla, senza distinguervi un'immediata utilità, la chiamiamo bella. [...] Le origini del bello, del buono, del gradevole sono dunque in noi stessi; ricercarne le ragioni vuol dire cercare le cause dei piaceri del nostro animo.'

Questo scritto - composto presumibilmente tra il 1736 e i1 1743 - è il più importante tra quelli lasciati inediti e incompiuti da Montesquieu. La sua importanza risiede essenzialmente nel fatto che esso contiene la più esauriente formulazione - prima della sistemazione definitiva messa a punto nella terza parte (libri XIV-XIX) dell''Esprìt des Lois' (1748) - della categoria più originale, accanto al concetto di dispotismo come forma autonoma di governo e al principio dell'autonomia della giustizia, tra le innumerevoli elaborate dal filosofo francese, vale a dire la categoria dello spirito generale o del carattere - dell'identità, come diremmo oggi - di una nazione o di un popolo.

The Spirit of Laws is one of the most influential books of all time. This masterpiece of political philosophy was widely read throughout Europe, attracted an especially enthusiastic readership in England, and had a profound effect on the framers of the American Constitution. Montesquieu (1689-1755), already famous and controversial through his Persian Letters, a work of his youth in which he humorously satirized the foibles of French society, turned in his later years to this serious treatise on the nature of law. But though the subject itself was profound, this gravitas did not inhibit the famous Montesquieu wit. Master of the pithy bon mot, he managed to survey a great deal of political and philosophical territory while keeping his readers charmed with memorable and artfully turned phrases. 'Liberty,' he says, 'consists in the ability to do what one ought to desire and in not being forced to do what one ought not to desire.' Concerning the unpopularity of the English in France, he says it is due to their arrogance, which is such that even in peace 'they seem to negotiate with none but enemies.'

The scope of this masterful work is truly prodigious. Montesquieu explores the essentials of good government; compares and contrasts despotism, monarchy, and democracy; and discusses the factors that lead to corruption of governments. Among the many other topics considered are education of the citizenry, crime and punishment, abuse of power and of liberty, individual rights, taxation, slavery, the role of women, the influence of climate on the temper of a people and their form of government, commerce, religion, and a host of additional subjects.


The Spirit of Laws is essential and genuinely enjoyable reading for anyone interested in the development of democracy.

Opera storica d'importanza fondamentale non solo per l'Europa dei Lumi, le «Considerazioni» furono date alle stampe, anonime, nel 1734. Ben più che sui meri fatti dell'antica Roma, Montesquieu si concentra sulla loro portata politica e sulla lezione di filosofia della storia che da essi si può trarre. I Romani furono grandi e prosperi finché si governarono secondo alcuni principi: l'amore per la libertà, il lavoro e la patria, la severa disciplina militare, la saggia politica del Senato nei confronti dei popoli vinti. Fino a non molto tempo fa, presentare l''Esprit des lois' significava presentare praticamente tutta l'opera politica di Montesquieu, ché, in questo campo, alle Considérations e alle Lettres Persanes veniva assegnata una funzione meramente secondaria. L''Esprit des lois' rimane dunque l'opera fondamentale, ma non tanto perché sia la più perfetta o perché Montesquieu sia tutto se stesso soltanto in essa, bensì perché quest'opera ha rappresentato, pur attraverso lunghe esitazioni ed incertezze e dopo numerosi tentativi, la realizzazione dell'obiettivo costantemente perseguito durante tutta la vita dello scrittore.
